Police charge Pa. man found dribbling along I-78

BETHLEHEM, Pa. (AP) — A 22-year-old Pennsylvania man faces charges after police encountered him dribbling a basketball along Interstate 78 near Bethlehem.

The Express-Times of Easton reported Monday (http://bit.ly/V4EZ9e ) that police said Marquis Johnson, of Hatfield, was found on Sunday with a Pennsylvania license plate sticking out from his shirt and shorts, and smelled of marijuana.

Police say a key in Johnson's possession matched a vehicle about 2 miles away that didn't have a license plate.

They say he wouldn't answer questions about the vehicle, and they found marijuana in the car. The vehicle had less than 700 miles on the odometer and was traced to a dealership.

Johnson is charged with unauthorized use of a vehicle, abandoning a vehicle and drug possession. Court records didn't list a defense attorney.

DWI charge for NY man asleep in car at drive-thru

NEWSTEAD, N.Y. (AP) — You want a wake-up call with that?

State police say troopers were called to a western New York McDonald's last weekend for a report of a man asleep behind the wheel of a car in the drive-thru lane.

When troopers arrived at the fast-food restaurant in the Erie County town of Newstead at about 2 a.m. Saturday, they found the 32-year-old driver sleeping at the wheel of his car with the engine running.

The troopers woke him up and gave him sobriety tests, which he failed. Police say he was charged with driving while intoxicated for having a blood-alcohol content of 0.14 percent, nearly twice the legal limit of 0.08 percent.

Troopers say the man lives in Newstead, a rural town 20 miles east of Buffalo.

Calif. man's charge upped to murder after boasting about speeding on Twitter Published August 15, 2013Associated Press

PLEASANTON, Calif. –  An 18-year-old accused of killing a bicyclist with his car has had a vehicular manslaughter charge upgraded to murder in part because he boasted about speeding on Twitter, prosecutors said Thursday.

Cody Hall, of Pleasanton, was being held without bail after he was charged Wednesday with the murder of 58-year-old Diana Hersevoort, the San Francisco Chronicle and Oakland Tribune reported.

Hall was going more than 80 mph in a 40 mph zone when he hit Hersevoort and her husband along a busy boulevard in Dublin on June 9, prosecutors allege.  Hersevoort's husband only broke an arm, but she was killed.

An analysis of Hall's driving record, along with Twitter posts in which he discussed how fast he liked to drive, persuaded prosecutors to change the charge to murder, the Alameda County district attorney's office told the Chronicle.

Prosecutors did not immediately reply to messages left by The Associated Press, and a Twitter account apparently belonging to Hall is restricted from public view.

Brian Welch, a supervisor of the homicide unit at the Santa Clara County district attorney's office who is not involved in this case, told the Tribune that in most circumstances, fatal crashes result in murder charges when the suspect was recklessly fleeing police or was a drunken driver with previous convictions, not because of something like a Twitter feed.

Welch said in this case it is likely the tweets will serve as what's called a "pre-offense statement," often an email, handwritten note or text message, used to bolster prosecutors' attempt to prove malice.

"The challenge in these situations is proving that your defendant is the person who posted the statement," he said.

Neither the newspapers nor The Associated Press could reach an attorney for Hall for comment.

Eating champ 'El Wingador' indicted on drug charge

WOODBURY, N.J. (AP) — A five-time wing-eating champion known as "El Wingador" has been indicted in New Jersey on cocaine distribution charges.William Simmons is charged with four counts of possession of a controlled dangerous substance and one count of manufacturing or distribution of more than a half ounce of cocaine in June.
The South Jersey Times (http://bit.ly/XpPsaf ) reports the 51-year-old Woodbury Heights resident is also charged with six counts of manufacturing or distribution of more than a half ounce and less than five ounces of the drug and two counts of manufacturing less than half an ounce.
"El Wingador" last won Philadelphia's Wing Bowl in 2005 when he gnawed through 162 chicken wings. Wing Bowl was started as a way for Philadelphia sports fans to blow off steam before the Super Bowl.
